Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Noah Mehrle ("Pour", "we", "us") governing your use of the Pour iOS app and related services ("Pour"). By downloading, opening, or using Pour — and by tapping Agree & continue on the welcome screen the first time you launch it — you accept these Terms. If you don't agree, don't use Pour.

1. Who can use Pour

You must be of legal drinking age in your jurisdiction (at least 21 in the United States) and able to form a binding contract. Pour is for your own personal, non-commercial use. We may ask you to confirm your date of birth, and we may refuse or revoke access if we believe you don't meet these requirements.

2. Your license to use Pour

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Pour on Apple devices you own or control. This license is governed by Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula, which is incorporated into these Terms by reference. Where these Terms and the Apple Standard EULA conflict, the terms more protective of you as a consumer apply to the extent required.

3. Your content, and the license you give us

You own what you create. Your pours, notes, ratings, photos, videos, companions, and locations ("Your Content") belong to you. We don't claim ownership.

So that Pour can actually work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, back up, process, display, and reproduce Your Content only as needed to run the features you use — for example, to sync your journal across your devices, to show a pour to the friends you choose to share it with, and to generate an AI recap or map when you ask for one. This license ends when you delete the content or your account, except for (a) copies friends already saw or saved while you were sharing, and (b) routine backups that age out of our systems on a schedule. You are responsible for Your Content and for having the rights to any photo or material you add, and you agree not to upload anything you don't have the right to share.

4. Social & sharing features

Pour is private by default. Sharing is something you turn on, pour by pour.

5. Community standards — zero tolerance for objectionable content and abuse

Pour has zero tolerance for objectionable content or abusive behavior. You agree not to create, upload, share, or send any content — or behave in any way — that:

How we enforce this. You can report any pour or user, and block any user, from within the app. We review reported content and users and act on reports promptly — typically within 24 hours. There is no warning requirement: we may remove content and permanently remove the account of anyone who violates these standards, at our sole discretion. Removal for a violation does not entitle you to any refund of unused credits. By using Pour's social features you agree to this zero-tolerance policy and that we will enforce it.

6. Reporting, blocking & moderation

Every shared pour and every profile has a way to report it and to block the person. Blocking ends any friendship between you and hides you from each other. Reports go to a queue we review and act on promptly (typically within 24 hours); we may remove content, limit features, or remove accounts to enforce these Terms or the law. Knowingly false reports may themselves result in action against your account. To report something outside the app, or to appeal an action, email noah.mehrle2@gmail.com.

Copyright & DMCA. We respect intellectual-property rights. If you believe content on Pour infringes your copyright, email noah.mehrle2@gmail.com with a notice that includes: (1) identification of the copyrighted work; (2) where the infringing material appears in the app (the pour, profile, or account); (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature. We remove infringing material we're notified of, and we may remove the accounts of repeat infringers.

7. Acceptable use

You also agree not to: (a) reverse-engineer, decompile, or interfere with Pour or its backend except as permitted by law; (b) access the service in an automated or abusive way, scrape data, or circumvent security, rate limits, or purchase controls; (c) use Pour for any unlawful purpose; or (d) try to access another user's account or data. We may suspend or terminate access for violations.

8. Purchases — Credits

Pour is free to download and use. Logging pours, adding friends, and building and browsing your map don't cost anything. Certain features — AI recaps, PDF export & print, and shareable map images — are powered by credits, an optional in-app purchase. You buy credits in one-time packs and spend them when you use those features.

9. Privacy

Your use of Pour is also governed by our Privacy Policy, which explains what we collect, where it's stored, and the choices you have. Please read it.

10. Responsible enjoyment

Pour is a journal, not an encouragement to overconsume — and it's just as happy logging a coffee or a mocktail. Please drink responsibly, follow your local laws, and never drink and drive. Pour is not a health, medical, or treatment service.

11. Service changes & availability

We may modify, suspend, or discontinue parts of Pour at any time. Backend-dependent features (sync, social, AI recaps, shareable map images) require connectivity and may be unavailable from time to time. We're not liable for any unavailability.

14. Your responsibility & indemnification

You are solely responsible for Your Content and your use of Pour. To the extent permitted by law, you agree to indemnify and hold harmless Noah Mehrle from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the social features, your misuse of Pour, or your violation of these Terms or anyone else's rights.

15. Apple — third-party beneficiary

These Terms are between you and us, not Apple, and Apple is not responsible for Pour or its content. You and we acknowledge that: this license is limited to Apple devices you control; we, not Apple, are responsible for Pour, its content, any maintenance and support, and any product-liability or legal claims relating to it; Apple has no warranty obligation for Pour; and if Pour fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the app. You represent that you are not located in a U.S.-embargoed country and are not on a U.S. prohibited-parties list. To the extent permitted, Apple is a third-party beneficiary of these Terms and may enforce them against you.

16. Termination

You may stop using Pour at any time, delete the app, and delete your account and its data from Profile → Settings → Delete Account. We may suspend or terminate your access if you violate these Terms — immediately and without notice for violations of Section 5. Sections that by their nature should survive (ownership, the license for content others already saw, disclaimers, liability limits, indemnity, and governing law) survive termination.

17. Governing law & disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Ohio, except where applicable consumer law gives you other rights.

18. Changes to these Terms

We may update these Terms. When we make material changes, we'll update the "Last updated" date and provide reasonable notice (and may ask you to re-acknowledge in the app). Continued use after changes means you accept the updated Terms.
